Terms of Business

1. Fees

1.1 Quotations for fees are for a firm three months from the date of the fee proposal. If acceptance is made after that period, or the work does not commence until after that period, the right to adjust the quotation, if necessary is reserved.

1.2 Payment of the initial stage fee, plus VAT, will become due on acceptance of the fee proposal. Thereafter, invoices for the progress payments will be rendered at the end of each month, or on completion of distinct stages of the project.

1.3 25% of the overall costs plus VAT will become due on acceptance of the fee proposal.

1.4 Acceptance of subsequent stage fees and estimated expenses, and verbal instructions to proceed to a
further stage of work must be confirmed in writing.

1.5 Where specified travel and subsistence expenses due to late night or weekend working will be charged
as extra to the fees quoted.

 

2. Estimates

2.1 The amounts set out under the headings of production costs and expenses are estimates, and as such serve as a guide to budgetary figures only. Where possible, firm quotations will be supplied as the work progresses.
 

3. Changes

3.1 Changes to the brief requiring extra work that is not described in the fee proposal, may result in additional charges. Where possible these will be negotiated and agreed before any further work is put in hand, otherwise work will be charged on the basis of current hourly rates.
 

4. Termination

4.1 If a project is terminated before completion, according to the original agreement, the Client agrees to pay for time and expenses incurred up to the date of termination. Time spent will be charged at current hourly rates.
 

5. Obligations

5.1 The Client agrees to settle all accounts within 14 days of the date of invoice. In the event of nonpayment of accounts at the correct time, any work in hand for the Client will be discontinued until all the outstanding amounts are settled. Interest will be charged at 3 per cent above base rate in force from the date of default until the date of payment in full. This paragraph is subject to any specific terms of payment set out in the fee proposal.

5.2 The Client agrees to be held responsible for any errors or omissions in typesetting, artwork, illustrations, photographs, proofs etc., which have been approved and/or signed by the Client prior to production.

5.3 The Client agrees to provide pristine sample copies of all printed work at no extra cost and in reasonable numbers.
 

6. Copyright

6.1 The copyright of all work produced remains that of the author and must not be reproduced, retained, disclosed or offered for sale to any unauthorised person, either wholly or in part, without obtaining prior written consent.

 

7. Miscellaneous

7.1 Should the Client cancel a project after acceptance of the fee proposal, but prior to commencement of
any work, a cancellation charge of between 50 and 75 per cent of the first stage of the fee will be retained.

7.2 A commission shall be terminated if the Client fails to remedy a breach of the above conditions within
14 days of receiving written notification specifying the breach and the action required to rectify it.

7.3 The Evewright Studio will assist in the selection of manufacturers, printers, etc., but the ultimate
choice and responsibility for their work rests with the Client.

7.4 Where necessary The Evewright Studio will assist the Client in the selection of professional consultants, but any appointments will be made by the Client, and the consultant will remain the client’s responsibility.
